Pismo američkom državnom sekretaru Antony Blinkenu: SMIJENITE PALMERA!

Poštovani gospodine Blinken!

Obraćamo Vam se da izrazimo našu duboku zabrinutost nastojanjima Vašeg predstavnika Palmera da Bosni i Hercegovini nametne izborni zakon koji bi nagradio politike Srbije i Hrvatske, koje su presuđene kao zločinačke i agresorske od strane ICTY i Internacionalnog suda pravde.

Da podsjetimo, to su one iste politike koje su tokom II svjetskog rata kolaborirale sa njemačkim nacistima protiv kojih ste se i sami borili. Teško nam je povjerovati da su sada te politike postale nešto što odobravate i podržavate, barem putem svojih izaslanika poput Palmera. Naime, izborni zakon koji vaš predstavnik Palmer pokušava već drugi put ove godine nametnuti promovira fašističku politiku segregacije i aparhejda, dajući ekskluzivno pravo ‘legitmnijeg’ od ostalih, a ostalima uskraćujući pravo da budu legitimni, što vodi ka podjeli i uništenju naše države.

Model izbornog zakona kojeg nudi američki predstavnik Matthew Palmer vodi ka daljem urušavanju Bosne i Hercegovine, cementiranju etnički čistih prostora koji su takvi postali genocidom i najtežim ratnim zločinima na tlu Evrope od II svjetskog rata. To bi vodilo i ka stvaranju evropskog pojasa Gaze, u kojem bi tavorila civilizacija, odnosno građani lojalni državi Bosni i Hercegovini i konceptu grđjanskog društva, sve do njenog (države Bosne i Hercegovine)  potpunog nestanka.

Gospodine Blinken, takvo ponašanje i odnos prema Bosni i Hercegovini predstavlja narušavanje njenog suvereniteta jer dopušta da kroz svoje poluge moći u našoj državi (tj. one koje samo oni smatraju i odaberu za ‘legitimne’) politiku na bh.prostorima vode dvije susjedne, agresorske države Srbija i Hrvatska, što predstavlja i kršenje međunarodnog prava od strane vaše zemlje jer američki predstavnik Palmer ipak predstavlja istu. Dejtonski sporazum je samo ‘mirovni ugovor’, čiji je cilj bio zaustaviti oružane sukobe, odnosno agresiju. Namjera istog je bila da bude privremenog karaktera, a nikako nešto na čemu će se graditi naša država. Taj je sporazum nagradio presuđenu agresiju i genocid, a tvorevina koja je odgovorna i presuđena za taj genocid, entitet Republika srpska, i dalje postoji. A vi i dalje insistirate na tom i takvom Dejtonskom sporazumu. Zar Vašoj zemlji ništa ne znači ‘ius cogens’ norma?

Vaš predstavnik Palmer svojim prijedlogom izbornog zakona za našu zemlju nastoji po svaku cijenu cementirati srpski i hrvatski nacionalizam koji u osnovi ima fašističku ideologiju po kojoj bi ih njemački nacisti mogli vidjeti kao svoje istinske i vjerodostojne sljedbenike.

Također, Palmer govori jezikom ruskih predstavnika (‘konstitutivni narodi’) koji promoviraju takvu podjelu a koja bi im omogućila cementiranje ruskog uticaja i prisustva u našoj zemlji i time trajno onemogućila njene euro-atlantske integracije za koje imamo vašu podršku i na kojima predano već godinama radimo.

Podsjećamo Vas da u Dejtonskom sporazumu ne postoje nikakvi ‘konstitutivni narodi’ već postoje konstituenti, izraz koji se koristi u modernim građanskim društvima da označi ‘izbornu bazu’. Također Vas podsjećamo da u Preambuli Anexa 7 Dejtonskog ustava stoji sljedeće: “Bošnjaci, Hrvati i Srbi, kao konstituenti (zajedno sa ostalima) i građani Bosne i Hercegovine ovim određuju da je Ustav Bosne i Hercegovine sljedeći:” Dakle, nikakva ‘konstitutivnost’ ne postoji. Ona je samo izmišljena konstrukcija koja jednako koristi nacionalistima da opstaju na vlasti, kao i Rusima da našu državu trajno podjele i zacementiraju svoj i kineski uticaj u njoj.

Ono što zaprepašćuje jeste da američki predstavnik Palmer razgovore o izbornom zakonu vodi isključivo sa ‘plemenskim poglaviciama’ ( liderima tri nacionalne stranke), što je neprihvatljivo i čime se potpuno zanemaruje velika većina građana naše države koju ni jedan od njih ne predstavlja. Podsjetili bismo Vas da su tri naconalne stranke dobile na prošlim izborima 2018. godine mali procenat glasova (ispod 25 posto od ukupnog biračkog tijela), a  služeći se svim vrstama izbornih prevara i krađa. Takvim potezima americki predstavnik Palmer potpuno zanemaruje presude Evropskog suda za ljudska prava u Strazburu u predmetima ‘Sejdic- Finci et al’a koje nalažu da se dokine svaka vrsta diskriminacije u Bosni i Hercegovini. A pošto ta diskriminacija proističe iz samog Dejtonskog ugovora, on je diskriminatoran i protivan Evropskog povelji o ljudskim pravima te kao takav pravno ništavan i neodrživ jer je ta Povelja iznad svakog zakona i ugovora koji joj je protivan.

Nešto što također smatramo  potpuno neprihvatljivim jeste odnos američkog predstavnika Palmera prema državi Bosni i Hercegovini. Naime, u svojim pokušajima da nametne taj, u osnovi fašistički izborni zakon, isključivo je fokusiran na entitet Federacija BiH. Izborni zakon jeste i mora važiti na teritoriji cijele države Bosne i Hercegovine, dakle, oba njena entiteta. Palmerovo nastojanje da se o izbornom zakonu razgovara samo na nivou jednog od dva bh. entiteta put je u stvaranje trećeg entiteta, odnosno ostvarivanju zločinačke nakane Republike Hrvatske o otimanju dijela naše države, a koja je presuđena od strane Haškog tribunala kao “udruženi zločinački pothvat”.To zapravo  pokazuje njegovo nepriznavanje države Bosne i Hercegovine kao cjelovite, suverene i nezavisne države, što predstavlja kršenje međunarodnog prava.

Prije nego pismo privedemo kraju, napravit ćemo malo digresiju kako bismo Vam demonstrirali Palmerov odnos prema trenutno veoma kompleksnoj političkoj situaciji u našoj zemlji: naime, Palmer je antidejtonske, neustavne i secesionističke poteze člana Predsjedništva BiH iz reda srpskog Milorada Dodika nazvao ‘retorikom’, iako se taj termin može koristiti samo u kontekstu verbalnih prijetnji. Čini nam se da po Palmerovom mišljenju u tu istu retoriku spada  i masovno naoružavanje civila u bh. entitetu ‘Republika srpska’ (npr. 20,000 cijevi podijeljeno je proteklih dana samo u Banja Luci, Prijedoru i Doboju), ulazak pripadnika vojske Republike Srbije na terotoriju Bosne i Hercegovine bez dozvole i zvaničnog protokola, te slijetanje ruskih vojnika u Banja Luku.

Napominjemo Vam da, prema Ustavnom zakonu koji je donijela Parlamentarna skupština Bosne i Hercegovine 12.  decembra 1995., objavljenog u Službenom listu RBiH broj 49/95, ukoliko dođe do kršenja Dejtonskog ugovora, Bosna i Hercegovina ima pravo vratiti Republiku Bosnu i Hercegovinu i Ustav Republike Bosne i Hercegovine (odnosno uređenje i Ustav koji su postojali prije Dejtona, a u skladu sa pravilima ugovornog prava).

Obzirom da je Miloard Dodik svojim antiustavnim i antidejtonskim potezima prekršio Dejtonski ugovor, mi imamo pravo da vratimo Ustav Republike Bosne i Hercegovine i tražit ćemo pokretanje tog postupka. A od Amerike, koju i dalje smatramo prijateljem, tražit ćemo da nam u implementaciji istog pomogne.

Zbog Palmerovih navedenih postupaka koji su sasvim neprihvatljivi, koji su nedorasli potezima ozbiljnog političara, koji predstavljaju i prijetnju za mir i stabilnost u regionu, a takvi mogu koristiti samo i isključivo ruskim interesima, tražimo od Vas da ga smijenite i na njegovo mjesto postavite izaslanika  koji će pomoći našoj državi da postane istinsko građansko i demokratsko društvo, bez nacionalnih okova i uticaja nacionalističke politike.

Dear Mr. Blinken,

We have decided to approach you to express our grave concern over the attempts of your representative, Matthew Palmer, to impose on Bosnia and Herzegovina an electoral law that would reward the politics of Serbia and Croatia, which were ruled by the ICTY and International Court of Justice as criminal.

We would like to remind you that those are the politics which collaborated with the German Nazis during WWII- the politics that you too, fought against. We find it hard to believe that those politics have now become the ones that you support and approve of, at least as it appears from  what your envoy Palmer has been doing.

Namely, Palmer has been trying, for the second time in a row this year, to impose and promote the fascist politics of segregation and apartheid, giving an exclusive right of a ‘more legitimate’ over the others, and depriving the others of the right to be legitimate, which would lead to further carve up and destruction of our country.

The model of electoral law proposed by the US envoy, Matthew Palmer, is bound to lead to further destruction of our country, Bosnia and Herzegovina, and would cement ‘ethnically pure’ parts of the country which had been ‘ethnically cleansed’  through genocide and worst war crimes in Europe since WWII. That would lead to the creation of European Gaza, where the civilisation would be struggling to survive till it (Bosnia and Herzegovina) finally disappears.

Mr. Blinken, such actions and approach towards Bosnia and Herzegovina constitutes breach of its sovereignty as it allows Serbia and Croatia, two countries that committed acts of aggression on our country, by using  their ‘puppets on the string’ in our country (i.e. only those that they consider and choose as ‘legitimate’), to pursue their politics in Bosnia and Herzegovina, which constitutes breach of international law on part of your country as the American envoy, Palmer, does represent your country.

Dayton Peace Accords is only a ‘peace accords’ brokered to halt the armed conflict (i.e. aggression). The aim of that agreement was to be temporary in nature, and not by any means, something that our country would be founded on. 

That agreement rewarded acts of aggression and genocide ruled as such by the highest world courts of law, with   the ‘creation’ of the Bosnian entity  ‘Republika srpska  that was ruled responsible for genocide that still continues to exist. Does ‘ius cogens’ norm mean anything to your country?

Your envoy Palmer, by pursuing his proposal of an electoral law for our country has been trying, at any cost, to cement Serb and Croat nationalism founded on fascist ideology  which German Nazis would see as  their genuine and true followers.

Furthermore, Palmer uses the ‘vocabulary and phrases’  used by Russians (e.g. ‘constitutive peoples’) which promote such a division, and which would then make it possible for the Russian influence and presence to be cemented permanently in our country, thus, preventing our Euro-Atlantic integration that we have been working hard on for many years now.

We would like to remind you that there are no ‘constitutive peoples’ in Dayton Peace Accords. There are only ‘constituents’- an expression used in civic societies to refer to their electorate.

We would also like to refer to Preamble of Annex VII of Dayton Peace Accords that reads as follows: “Bosniaks, Croats and Serbs, as constituent peoples (along with others) and citizens of Bosnia and Herzegovina determine the Constitution of Bosnia and Herzegovina to be as follows:”

In other words, there is no ‘constitutivity’ at all! It is just a construction made up to be used by nationalists to remain in power, as well as to Russians to permanently partition our country, and cement their influence as well as that of China.

What we find surprising is that the American envoy, Palmer has been holding talks on electoral law with ‘tribal Chiefs’ (i.e. the leaders of three national parties) only, which is unacceptable, and which completely disregards the vast majority of citizens of our country who are not represented by either of the three.

Just to mention that the three national parties ‘won’ the 2018 elections by a very low magine (approximately 25% of the entire Bosnian electorate), and even that was won by electoral fraud and cheating.
Such actions on part of the American envoy, Palmer, show complete disregard for the rulings of the European Human Rights court in Strasbourg in the cases ‘Sejdic-Finci et al’, and which have ordered for any sort of discrimination in Bosnia and Herzegovina to be put to an end.

As discrimination results from Dayton Peace Accords, that agreement is discriminatory and contrary to the European Human Rights Charter, and as such legally null and void as the Human Rights Charter is above and beyond all laws and agreements that are contrary to it.

We also consider Palmer’s approach to Bosnia and Herzegovina as  a state to be completely unacceptable. Namely, in his persistent attempts to impose that, in its very base fascist electoral law, he keeps focussing on the entity of Federation of Bosnia and Herzegovina only. And, electoral law is for, and must apply to the entire country of Bosnia and Herzegovina, i.e.  it must apply to both of its entities.

Palmer’s attempts to hold talks on electoral law at a level of one of the two Bosnian entities only is a secure and certain path to the creation of a ‘third entity’. In other words, it is to help the Republic of Croatia with its criminal intent to steal part of our country – something that had been ruled by the ICTY as ‘joint criminal enterprise’. That only shows that he does not recognise Bosnia and Herzegovina as a whole, sovereign and independent country, which in itself constitutes breach of international law.

Before bringing this letter to an end, we would like to digress slightly in order to demonstrate to you Palmer’s approach to a very complex current situation in our country. Namely, Matthew Palmer referred to anti-Dayton, unconstitutional and secessionist moves and actions made by the member of the Bosnian Presidency, Milorad Dodik,  (a Serb) as ‘rhetoric’, although such a term can only be used in the context of verbal threats.

It appears to us that, according to Palmer’s views, the mass distribution of arms to the Serb civilians in the Bosnian entity of Republika srpska (e.g. only recently 20,000 riffles have been distributed in Banja Luka, Prijedor and Doboj), the Serbian army entering Bosnia and Herzegovina without any permission or, without following  the formal state protocol, planes bringing  Russian soldiers landing in Banja Luka, could also be referred to as ‘rhetoric’.

Finally, we would like to remind you that, according to the Constitutional law passed by the Parliamentary Assembly of Bosnia and Herzegovina on 12th December 1995, published in the Official bulleting of the Republic of Bosnia and Herzegovina No. 49/95, in case there is a breach of Dayton Peace Accords, Bosnia and Herzegovina has the right to restore the Republic of Bosnia and Herzegovina and the Constitution of the Republic of Bosnia and Herzegovina (i.e. the legal and social set up that had existed before Dayton Peace Accords as granted by contract law provisions).

Given that Milorad Dodik, has, by his unconstitutional and anti-Dayton actions, breached Dayton Peace Accords, we have every right to restore the Constitution of the Republic of Bosnia and Herzegovina, and will demand that such action takes place. And, from the USA that we consider a friend, we shall seek help with implementing it.

Due to Palmer’s actions set out in this letter, and which are completely unacceptable, are not on a level of a serious politician, and which also constitute a threat to peace and stability in the region, and as such can only be useful to the Russian interests, we wish to ask you to remove Palmer as an envoy, and replace him by someone who will help our country to become a true civic and democratic society free of burden of nationalism and nationalist politics.
